ABSTRACT

Judicial decisions must have legal implications for relevant parties. PMK No. 2/PUU-XIX/2021 remains debatable between creditors and debtors because it seemingly weakens the protection of creditors' rights. Creditors cannot immediately carry out enforcement procedures that cut off the creditor's business flow because the position of the subject of fiduciary obligations is in the debtor's control, making it possible for disputes between debtors and creditors. This normative legal research was conducted using a philosophical, juridical approach covering statutory policies, conceptual and case approaches. PMK No. 2/PUU- XIX/2021 does not regulate creditor legal provisions in enforcing fiduciary securities, making it difficult for creditors to execute them. The Constitutional Court should decide to guarantee justice for all parties and provide a decision with clear content and sentence structure, so multiple interpretations will not occur. The execution of fiduciary securities during the Covid-19 pandemic should not be immediately carried out because the creditor had to follow the predetermined procedures. © 2023, University of Muhammadiyah Malang. ABSTRACT

Instructional is a learning process that discloses knowledge and actively seeks knowledge or formulates knowledge. A learning Management System is needed to tools distance learning in the current COVID-19 pandemic. The research aims to produce a Learning Management System as a tool for distance learning. This research was conducted for six months to create a Learning Management System integrated with an instructional video. The initial stage is to analyze the needs following the student’s characteristics. The next step is to formulate the instructional objectives and be described them into specific objectives, designing a competency map in sequences of instructional goals to be achieved. Develop activities and feedback. The use of graphics must also be adjusted to digital media development characteristics because it will affect learning Management System appeal. The last thing in this stage is to formulate a physical form for digital media to be developed. It involved 41 respondents divided into three groups: the one-to-one test group of three respondents, a small group of eight respondents, and a field test of 30 respondents—instruments used in effectiveness tests with pre-test and post-test. The validation of expert teams with an average score of 88.06% means that developed digital media is worth using. While the test results of learning Management System effectiveness p-value < 0.05 (with a confidence level of 95%). A mean value of 9,139 is positive, meaning an average post-test score increase of 9,139. It can be concluded that android-based digital media integrated with video learning is helpful as a tool to distance learning. By mandating the internet network, distance learning causes many acceptance problems due to unstable networks, demographic location, and internet quotas owned by students. Therefore, it is recommended to look for other sources to help distance learning.
